CONCERNED PARENT COMPLAINT
Dear Mrs. Mester
On April 27, 2011 at 8:45 am I, Carlos Vega dropped off my four year old son Xavier Vega at Chopin head start program with Mrs. Fitzsimmons head start teacher (room 112). Mario Santiago picked up Xavier Vega at 11:45 am from dismissal. When I, Carlos Vega came home from work I notice my son Xavier Vega left eye swollen and bruised at that point I asked him what happened and he told me that another child punched him in the eye while he was washing his hand in the class washroom. Xavier got up set and started to cry and told his teacher Mrs. Fitzsimmons but the teacher ignored the situation and didn’t believe it was appropriate and necessary to make an incident report. Our concerns as parents are:
1. Is Chopin School a safe educational environment for children to learn?
2. Are children being properly supervised by teachers?
3. Is it a school policy to make an incident report when physical harm is caused to a child/student?
4. Is it a school policy to inform parents of such physical harm?
We trust this is not the way Chopin School perform the responsibilities and duties of a public school. Our three children have been attending Chopin school for three years and I have never encountered such situation. I welcome the opportunity to discuss matters further and to learn how you propose to prevent a similar situation from recurring. However, if proper actions are not taken according to school policy, we will take this matter to higher authority. We look forward from hearing from you.

Dear Office of Evaluation and Accountability,
On April 28, 2011 I Carlos Vega and Tayni Illa parents of four year old Xavier Vega had a meeting with Chopin Elementary School Assistant Principal Mrs. Angela Beneyto Badillo and Mrs. Fitzsimmons head start teacher concerning physical harm caused to our child left eye. The meeting took place first with Carlos Vega, Tayni Illa, Xavier Vega and the assistant principal Mrs. Badillo. Xavier explained to the assistant principal, that he was in the class washroom washing his hands when the other child came in and turned him around and then punched him in the eye.
Xavier then told the teacher; Mrs. Fitzsimmons admits seeing something wrong with his eye but denied ever witnessing the incident. The assistant principal then called in the head start teacher Mrs. Fitzsimmons so she can hear and witness for her self what my child said. Xavier Vega then explained the same situation to the teacher which at that moment went into defensive mode and said that she felt sorry for Xavier because he is in a lot of pressure. That she felt it happened somewhere else. However, this is not the first time that my child gets bully and intimidated by the same child. Tayni Illa has spoken to Mrs. Fitzsimmons various times about such incidents.
After the meeting no actions where taken to correct the problem. At 10:23 am I filed a complaint with Specialized Services Administrator area 4 Mrs. Zayas.
On April 28, 2011at about 3:30 pm a DCFS employee came to my door because someone filled a domestic abuse and child abuse charge against Carlos Vega and Tayni Illa for Xavier Vega.
After the interview the DCFS employee left. One hour later Chicago Police Detectives come to my door stating that they spoke to Mrs. Fitzsimmons concerning a criminal abuse case. The detectives interviewed Xavier Vega and then left. We believe that these allegations were done under false pretense. We believe that the assistant principal along with the head start teacher conspired to intimidate and retaliate against a parent who spoke up against bullying and to protect their best interest. However, when the DCFS report come back unfounded we are going to peruse this matter and prosecute the perpetrator.
